he VA has finally automated the Rudisill ruling. Here is how to see if you are eligible for an extra 12 months of paid tuition.

A Game-Changer for Career Changers

For years, the VA forced veterans to make an “irrevocable election” between the Montgomery GI Bill (MGIB) and the Post-9/11 GI Bill. If you switched to Post-9/11, you were usually limited to a total of 36 months of benefits.

As of March 2026, the “Rudisill” era is officially in full swing. Following a landmark Supreme Court case, the VA has updated its systems to allow veterans with multiple periods of service to “stack” their benefits up to a maximum of 48 months.

1. Are You Eligible for the Extra 12 Months?

In 2026, the VA is automatically reviewing files for veterans who meet these specific criteria:

  • Multiple Qualifying Periods: You must have served enough time to qualify for the MGIB (Chapter 30) AND the Post-9/11 GI Bill (Chapter 33) separately.
  • The “3-Month” Trigger: The VA is currently prioritizing reviews for veterans who have less than three months of benefits remaining and are currently enrolled (or were enrolled in the last six months).
  • No “Double Counting”: You cannot use the same day of service to qualify for both programs, but most veterans with two enlistments or a reenlistment qualify easily.

2. No More “Requests for Review”

One of the biggest updates this month is that you no longer need to manually ask for a review.

  • The 2026 Automation: The VA’s new “Education Service Portal” now automatically flags accounts that qualify for the 48-month extension.
  • Notification: If you are eligible, you will receive a formal “Notice of Eligibility” in your VA.gov inbox and via mail. If you haven’t received one and believe you qualify, you can now check your status in real-time through the VA Health and Benefits app.

3. Chapter 35 (DEA) Rates for 2026

If you are a 100% P&T veteran, your dependents are likely using Chapter 35 (DEA). For the current academic year (ending September 30, 2026), the rates are at an all-time high:

  • Full-Time Student: $1,574.00 per month.
  • 3/4-Time: $1,244.00 per month.
  • 1/2-Time: $912.00 per month.
  • Important Warning: Congress is sunsetting the “High School DEA” benefit on August 1, 2026. If you have a child who turns 18 before then, they must apply now to receive those monthly payments while finishing high school.

4. Spousal Transfer: The 2026 “16-Year Rule”

There is a common myth that you can’t transfer your GI Bill after 16 years of service. This is false in 2026.

  • The Truth: You can transfer your benefits at any point while on active duty or in the Selected Reserve, provided you can commit to four more years of service.
  • Purple Heart Exception: If you received a Purple Heart, you are exempt from the “6 years served / 4 years remaining” rule and can transfer your benefits immediately, regardless of your time in service.

March 2026 Action Plan

  1. Check your “Entitlement Remaining” on VA.gov. If it shows 36 months and you had two enlistments, you may be owed another year.
  2. Review your dependents in DEERS. Ensure they are listed correctly before you attempt any transfers.
  3. Verify school enrollment. For the 48-month review to trigger automatically, your school must have certified your current semester.
